Welcome to Productech. These Terms of Service (“Terms”) govern your use of our websites, products, and services, including purchases made through our online stores. By accessing or using our services, you agree to be bound by these Terms.

1. OVERVIEW

This website is operated by Productech Corporation (“Productech,” “we,” “us,” or “our”), the parent company of TREBLAB®, Turonic®, Dictopro®, and PUROXYGEN®. These Terms apply to all users of our sites, including browsers, customers, and vendors.

2. ELIGIBILITY

You must be at least the age of majority in your state or country of residence to use our services without parental or guardian permission. By using our services, you represent that you meet this requirement and that all information you provide is accurate, complete, and current. Our services are not intended for individuals under the age of 13. See our Privacy Policy for our children's data practices.

3. PRODUCTS AND AVAILABILITY

All products are subject to availability. We reserve the right to limit quantities, discontinue products at any time, and change product descriptions or pricing without prior notice. We make reasonable efforts to ensure product descriptions are accurate but do not guarantee that all information is error-free.

4. PRICING AND PAYMENT

All prices are listed in USD unless otherwise specified. We reserve the right to correct pricing errors and cancel orders affected by such errors. Payments must be authorized at the time of purchase.

5. ORDERS AND CANCELLATION

Once an order is placed, it begins processing promptly. Orders may be canceled only if they have not yet been processed or shipped. If an order has already shipped, it must be handled in accordance with our Return & Refund Policy.

We reserve the right to refuse or cancel orders in cases of suspected fraud, unauthorized activity, or excessive or abusive return behavior. We may also limit or cancel quantities per person, household, or order, and refuse orders that appear to be placed by unauthorized resellers or distributors.

6. FEEDBACK AND SUBMISSIONS

If you submit feedback, suggestions, reviews, or other materials to us, you grant Productech a non-exclusive, royalty-free, perpetual right to use, reproduce, and incorporate such content for business purposes. We are not obligated to maintain such submissions in confidence, provide compensation, or respond to them.

7. SHIPPING AND DELIVERY

Shipping times and methods are outlined in our Shipping Policy. Delivery estimates are not guaranteed and may be affected by carrier delays or other external factors. Risk of loss transfers to the customer upon confirmed delivery by the carrier.

8. PAYMENT DISPUTES AND CHARGEBACKS

You agree to contact us at support@treblab.com before initiating any chargeback or payment dispute with your bank or payment provider, allowing us the opportunity to resolve the issue first.

We reserve the right to suspend or restrict access to our services, refuse future orders, or take other appropriate action if a customer engages in excessive, abusive, or fraudulent chargeback activity. Initiating a chargeback without first contacting us may be considered a violation of these Terms.

9. RETURNS AND REFUNDS

Returns and refunds are governed by our Return & Refund Policy. We reserve the right to inspect returned items and determine eligibility for refunds in accordance with that policy.

10. WARRANTY

All new Productech products are covered by our 1-Year Limited Warranty. Warranty terms, coverage, exclusions, and the claim process are outlined in our Limited Warranty Policy. Replacement products are covered for the remainder of the original warranty period and do not trigger a new warranty term.

11. PROPER USE OF PRODUCTS

Products must be used in accordance with the provided instructions and for their intended purpose. Improper use, unauthorized modification, or misuse may void the warranty, result in product damage, or create safety risks.

12. INTELLECTUAL PROPERTY

All content on our websites, including logos, product designs, text, images, and graphics, is the property of Productech or its licensors and is protected by applicable intellectual property laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our services, products, or content without our prior written permission. Unauthorized use is prohibited.

13. THIRD-PARTY SERVICES AND LINKS

Our services may include links to third-party websites or services not owned or controlled by Productech. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party websites.

14. LIMITATION OF LIABILITY

We do not guarantee that our services will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, Productech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Use of or inability to use our products or services
Delays in delivery
Product misuse or improper installation
Events beyond our reasonable control (natural disasters, war, pandemics, carrier strikes, or other force majeure events)

Our total liability in any matter shall not exceed the amount paid for the product giving rise to the claim.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Productech, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from your misuse of our products, violation of these Terms, or violation of applicable laws.

16. PROHIBITED USES

You may not use our services for:

Fraudulent or unlawful purposes, including violation of applicable laws or intellectual property rights
Reselling products without authorization
Attempting to interfere with, disrupt, or gain unauthorized access to our systems
Transmitting viruses, malware, or other harmful code
Abusing our return or warranty policies

We reserve the right to suspend or permanently terminate access to our services for violations of these Terms.

17. ACCOUNT TERMS

If you create an account on one of our websites, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. Productech is not liable for any loss or damage arising from your failure to maintain account security.

We reserve the right to terminate or suspend accounts at our discretion, including for inactivity, suspected fraud, or violations of these Terms.

18. EXPORT COMPLIANCE

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in, under the control of, or a national of any country subject to applicable trade sanctions, and that you will not export or re-export our products in violation of such laws.

19. DATA AND COMMUNICATIONS

You understand that information transmitted through our services (excluding payment information) may be transferred across various networks and may be adapted to meet the technical requirements of connecting systems. Payment information is encrypted during transmission using secure protocols.

20. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Note for international customers: Some jurisdictions, including EU member states and the United Kingdom, have mandatory consumer protection laws that may apply to you regardless of this governing law clause. Nothing in these Terms is intended to limit rights you may have under such laws.

21. DISPUTE RESOLUTION

Before filing any formal claim, you agree to contact us at support@treblab.com to attempt to resolve the issue informally.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may assert claims in small claims court if they qualify.

Arbitration shall take place in the State of Florida unless otherwise required by applicable law. Each party shall bear its own legal fees unless otherwise required by law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

Note: This arbitration clause may not apply to you if you are located in a jurisdiction that prohibits mandatory pre-dispute arbitration agreements in consumer contracts, such as certain EU member states.

22. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

23. ENTIRE AGREEMENT

These Terms, together with all referenced policies, constitute the entire agreement between you and Productech regarding your use of our services and supersede any prior agreements or communications.

24. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
